SAN DIEGO, CA - A nightmare for every greens keeper at virtually every golf course in the world is the un-repaired ball mark left on the green when the ball lands. Well, two California-based companies are taking one giant step toward making the scourge of the putting green a dinosaur. July 26, 2005 - DIVIX GOLF INC. Files Suit Against Remedy Golf and Bandwagon, Inc.
SAN DIEGO, CA - Divix Golf, Inc., manufacturer of DIVIX switchblade divot tools, filed suit today in Federal Court in San Diego, CA against Remedy Golf, Inc. for patent and trademark infringement. "The suit alleges that Remedy Golf is selling illegally imported divot tools domestically and has deliberately copied Divix's trade dress to confuse customers." The DIVIX switchblade divot tool is the most widely used switchblade divot tool across the many worldwide professional tours and the best-selling switchblade tool model at on and off-course golf shops in the United States.
The sale of the product was brought to the attention of Divix Golf, Inc. management by a consumer who purchased what he believed to be a DIVIX switchblade divot tool at a location in San Diego, CA. The consumer became concerned after using the product and examining the poor quality and lack of function of the product. The "Knock-Off " tools were verified to be infringing upon Divix Golf, Inc. products as were additional tools bought in several areas of the US including South Carolina and New Jersey. Remedy Golf is not an authorized manufacturer, licensee or distributor of DIVIX switchblade action divot tools and Remedy is alleged to be purchasing "Knock-Off" tools from China for resale in the US market.
"Infringing and counterfeiting golf products are a problem that has been present in the industry for years." said Chad Kolakowski, Vice President of Sales and Marketing for Divix Golf, Inc. "It's a shame that people steal ideas and products and directly infringe on patents with no regards to originality and integrity.
